Terms of Service
Effective: · Version 2026-10-draft
These Terms are the agreement between you and BOSIA Technology for using HRPETH, the healthcare jobs and talent platform at hrpeth.com and in the HR-Peth mobile app. Please read them with our Privacy Policy, which explains how we handle personal information.
1. About these Terms
HRPETH (the "Service") is operated by BOSIA Technology, registered in [country of registration] under number [registration number], with its registered office at [registered address] ("HRPETH", "we", "us"). The Service includes the website at hrpeth.com, the HR-Peth mobile app and the HRPETH application programming interface.
By creating an account, or by using the Service without an account (for example to search jobs), you agree to these Terms. If you use the Service for an organization, you agree on its behalf and confirm you are authorized to do so; "you" then includes that organization.
Our Privacy Policy forms part of these Terms. Some features (such as paid plans) may also be covered by a separate written agreement; if it conflicts with these Terms, the separate agreement wins for that feature.
2. Your account
- You must be at least [18] years old and able to enter into a binding contract to create an account.
- Give your real name and an e-mail address you control. We ask you to verify the address before the account can be used.
- One account is for one person. Do not share it, sell it or let anyone else use it. An organization gives each team member their own account through an invitation.
- Keep your password secret and use a strong one (at least 10 characters). We strongly recommend turning on two-step verification in your account security settings; it is required for HRPETH staff accounts.
- You are responsible for everything done through your account. Tell us at once at [security contact e-mail] if you think someone else has used it.
- The same account can be used as a professional (job seeker) and as a member of one or more employer organizations.
3. Using HRPETH as a professional
As a professional you can build a profile, upload documents such as your CV and copies of licences and certificates, save jobs, set job alerts and apply for jobs.
- Everything you add must be true, current and yours. Do not claim a qualification, licence, registration or experience you do not have. Misrepresenting healthcare credentials is a serious breach and may also be unlawful.
- Only upload documents you have the right to share. Do not upload other people's personal information or documents that are not about you.
- Do not put e-mail addresses, phone numbers, links or messaging handles in your headline, summary or experience. They are blocked or hidden, because contact details are shared with employers only in the controlled ways described in the Privacy Policy.
- Your profile is private until you choose otherwise. You decide whether verified employers can find it in Talent Search, and separately whether employers on a paid plan may see your contact details. You can change both at any time.
- When you apply, the employer receives a copy of your profile as it was at that moment, the CV you chose, your account e-mail and, only if you tick the box, your phone number. You confirm this each time you apply. The employer then handles your application under its own responsibility (see the Privacy Policy).
HRPETH does not employ you, act as your agent or guarantee interviews, offers or employment. Hiring decisions are made only by employers.
4. Using HRPETH as an employer
An organization (a hospital, clinic, pharmacy, laboratory or other healthcare employer) can register, be verified by HRPETH, publish jobs, receive and manage applications and, on eligible plans, search for professionals. By using these features the organization and each of its team members agree that:
- The organization information and documents submitted for verification (such as business registration and healthcare licences) are genuine, accurate and kept up to date. Changing the legal name, type or country of the organization requires verification again.
- The person who registers the organization, and every member it invites, is authorized to act for it. The organization is responsible for its members' actions and for removing members who leave.
- Every job published is a real, current vacancy with the organization (or a client it is lawfully authorized to recruit for, if we agree to that in writing), is lawful, and does not discriminate on grounds prohibited by law. Jobs must not ask candidates for fees.
- Candidate information (applications, CVs, profiles found in Talent Search and contact details) is used only to recruit for the organization's genuine vacancies. It must not be copied out of the Service in bulk, sold, shared with third parties, used for marketing or used to build a separate database.
- Candidate contact details opened through a paid plan are used only to contact that professional about relevant employment, and within the plan's monthly allowance. Professionals can see which employers opened their details.
- The organization complies with the employment, anti-discrimination and data protection laws that apply to it. For the applications it receives, the organization is responsible for its own handling of the candidate's information, including what it records in notes, interviews and offers.
- Interview invitations and offers sent through the Service are made by the organization, not by HRPETH.
We may limit, suspend or remove an organization's access to features (including hiding its jobs) if its verification lapses or is withdrawn, if it breaches these Terms, or to protect professionals.
5. What verification means
HRPETH checks some records, such as a professional's licence or certificate, or an employer's registration documents, against the evidence provided. A record marked "Verified by HRPETH" means only that:
- our reviewers examined that one record and the documents provided, and they appeared genuine and consistent at the time of review;
- the mark applies to that record, not to the person or the organization as a whole;
- the mark ends when the record expires and may be withdrawn if new information comes to light.
Verification is not a check by the Ministry of Health, a professional council or any other authority, and HRPETH is not connected to any official register. It is not a guarantee of a person's competence, character, fitness to practise or right to work, or of an employer's conduct. Employers remain responsible for their own pre-employment checks, including confirming registration with the relevant authority.
6. Plans and payment
Using HRPETH as a professional is free. Organizations can use a free plan with limits (for example the number of live jobs and team members). Paid plans add features such as Talent Search and access to candidate contact details.
- Prices are given on request and agreed in writing. Paid plans are invoiced and paid outside the Service (for example by bank transfer or KHQR); the Service itself takes no card payments.
- A plan starts when we activate it after payment, or on the terms of your written agreement. If a payment is overdue we may limit or suspend the paid features.
- Moving to a lower plan never deletes your data; features above the new plan's limits stop working.
- We may change plan features or prices for future periods with at least [30] days' notice. Changes do not affect a period already paid for.
- [Refund and cancellation terms to be confirmed.]
- Organizations on the free pilot plan will be told at least 7 days before it ends, and then move to the free plan unless they choose a paid one.
7. Acceptable use
You must not, and must not help anyone else to:
- post false, misleading, fraudulent or fake jobs, profiles, credentials or documents, or impersonate anyone;
- collect, scrape, harvest or download information from the Service by automated means or in bulk, or use it to build or improve another product or database;
- contact professionals or employers for anything other than genuine recruitment, or send spam, advertising or chain messages;
- ask candidates for money, or post jobs that are unlawful, exploitative, discriminatory or for work outside healthcare without our agreement;
- upload malware or files you are not allowed to share, or anything unlawful, defamatory, obscene or that infringes someone else's rights;
- try to get around privacy settings, plan limits, rate limits, contact-detail protections or security measures, or to access accounts, organizations or data you are not authorized to access;
- interfere with, overload or reverse-engineer the Service, except to the extent the law allows;
- use the Service in breach of any law, including employment, data protection and anti-discrimination law.
We may remove content and limit, suspend or close accounts that break these rules. Every access to candidate information by employers is recorded, and we review misuse.
8. Your content
You keep ownership of what you add to the Service (profile text, documents, job descriptions, organization details and logos).
You give HRPETH a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, display and transmit that content only as needed to run, secure and improve the Service and as your settings allow: for example, showing a published job to the public, or an application to the employer you sent it to. The licence ends when the content is deleted from the Service, except for copies we are allowed to keep under the Privacy Policy (such as an application already received by an employer).
If you send us suggestions or feedback, we may use them without any obligation to you.
9. Our rights
The Service, its software, design, text, the HRPETH name and logo and the HR-Peth app belong to BOSIA Technology or its licensors. These Terms give you a limited, personal, non-transferable right to use the Service as offered; they do not give you any other right in it.
10. The mobile app
- The HR-Peth app is licensed, not sold, for use on devices you own or control, under these Terms and the rules of the app store you got it from. Apple and Google are not parties to these Terms and are not responsible for the app or its support.
- Push notifications are optional: you choose them per category in the app, and can also turn them off in your phone's settings.
- Some features open the HRPETH website. Older versions of the app may stop working when they are no longer supported, and you will be asked to update.
11. Availability and changes to the Service
We work to keep the Service available and secure, but we do not promise it will always be available, uninterrupted or error-free. We may change, add or remove features. If we remove a feature that is part of a paid plan you have paid for, we will tell you in advance and [offer a fair adjustment].
12. Suspension and closing your account
You can close your account at any time. In the mobile app, open Account and then Delete account. You can also write to [support e-mail]. You confirm with your password. Your other sessions end and your profile is hidden at once. The account is then erased after a grace period, currently 14 days, during which you can cancel. What is erased and what is kept is explained in the Privacy Policy.
Some accounts cannot be closed this way until a step is taken first, for example a member of an organization must leave it or hand it over.
We may suspend or close an account or organization, with or without notice, if it breaches these Terms, if we must do so by law, if it puts other users or the Service at risk, or if a verification is withdrawn. Where reasonable we will tell you why and give you a chance to respond. Suspension ends all active sessions.
Sections that by their nature should continue after an account is closed (including content licences for retained records, disclaimers, limits of liability and governing law) continue to apply.
13. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we make no promises about it other than those in these Terms. In particular:
- Jobs, organization information, profiles and documents are provided by users. We do not guarantee that they are accurate, complete or lawful, or that any job will be filled or any candidate hired.
- Statistics and workforce figures in the Service come only from data on HRPETH. They are not official or national labour statistics.
- Talent Search filters help employers find profiles; they are not a judgement of a candidate's suitability.
- Nothing in the Service is medical, legal, immigration or professional advice.
Nothing in these Terms limits any right you have under consumer or other law that cannot be limited by contract.
14. Limits of our liability
To the extent the law allows, HRPETH is not liable for: decisions made by employers or candidates, or their conduct towards each other; loss of profits, revenue, business, opportunity or goodwill; or any indirect or consequential loss.
To the extent the law allows, our total liability to you for all claims relating to the Service in any 12-month period is limited to the greater of the amount you paid us for the Service in that period and [amount and currency].
We do not exclude liability that cannot be excluded by law, such as liability for fraud, or for death or personal injury caused by negligence.
15. Your responsibility to us
If an organization's jobs, use of candidate information or breach of these Terms leads to a claim against HRPETH, the organization will cover HRPETH's reasonable losses and costs from that claim, to the extent the law allows.
16. Changes to these Terms
We may update these Terms, for example when the Service changes or the law requires it. Each version has a number and an effective date shown at the top of this page, and we record which version you accepted. For changes that matter, we will tell you by e-mail or in the Service at least [30] days before they take effect, unless a change is needed sooner for legal or security reasons. If you do not agree, you can close your account before the change takes effect; if you keep using the Service after that, the new Terms apply.
17. Governing law and disputes
These Terms are governed by the laws of [the Kingdom of Cambodia]. Before starting any formal proceedings, please contact us so we can try to resolve the matter informally. If it cannot be resolved within 30 days, the courts of [Phnom Penh, Kingdom of Cambodia] have jurisdiction, unless the law gives you the right to bring proceedings elsewhere. [Dispute resolution mechanism to be confirmed by counsel.]
18. General
- These Terms (with the Privacy Policy and any separate written agreement) are the whole agreement between you and us about the Service.
- If a part of these Terms is found unenforceable, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your rights under these Terms. We may transfer ours to a company that takes over the Service, and will tell you if we do.
- These Terms are written in English. Where we provide a translation, the English version prevails if they differ.
